The latest stage in proposed legislation concerning letting agents and landlords was announced by Margaret Beckett in summer 2009. Under that proposal anyone letting residential property in England and Wales must appear on a national register. Such legislation already exists in Scotland, but the proposal for England and Wales has attracted some controversy.

Standards in renting property have certainly changed for the better since the times of notorious slum landlord Peter Rachman in the 1950s and 1960s. When managing his rented properties his methods were so appalling and discredited that the phrase ‘Rachmanism’ became so synonymous with high rents, poor quality housing and intimidation of tenants that it is now included in English dictionaries. Indeed, his activities were so notorious that they directly led to the passing of the 1965 Rent Act that afforded more protection to tenants, gave them rights that previously were not enshrined in law and restored a level of protection that had been relaxed by the previous Tory administration.

Since the 1960s more legislation has been passed primarily to protect the interests of tenants and so it is with the latest proposal. As well as compelling landlords to register on a national register in addition to with their local authority, the new legislation will also ensure that tenants receive a minimum of two months' notice if the property in which they live is to be repossessed. This is to protect tenants that have been given less than two weeks notice to vacate a property following the failure of their landlord to pay the mortgage.

In terms of protection offered to those renting out properties, landlords insurance policies ensure that they are covered should anything untoward happen to their building, such as fire, flood and other disasters meaning that their asset is protected. However, non-payment of rent by a tenant is usually the biggest problem faced by landlords and although insurance can be offered against that possibility not all policies have it included as standard.

Landlords can be prudent in ensuring that tenants are financially sound when they apply to live in their property, but should there subsequently be a change in a tenant’s financial circumstances landlords can be significantly affected. If such circumstances arise then landlords who have protection afforded by an assured shorthold tenancy agreement can charge reasonable interest on late payments or apply for eviction depending upon how long the tenant is in arrears.

MABA) is relieved that the Home Buyer Tax Credit legislation, which provides a maximum $8,000 tax credit to first time home buyers, has been signed and the deadline extended through April 30, 2010.

Now, first time home buyers who are in the process of purchasing a home don’t have the November 30, 2009 deadline hanging over them. It will also enable even more first time buyers to take advantage of the program over the next several months.

Due to a provision in the American Recovery and Reinvestment Act of 2009, taxpayers who have not owned a primary residence in at least three years time are considered “first time home buyers” and are eligible for a tax credit of up to 10 percent of a home’s purchase price (maximum $8,000).

The legislation has not only been extended, but expanded to include more buyers. A provision for homeowners who have lived in the same house for five consecutive years and are purchasing a new home meeting the remaining guidelines has also been added to the act. Those home purchasers may be entitled to a credit of up to $6,500.

In addition to the tax credits, the Federal Housing Administration (FHA) is allowing first time home buyers to use their tax credit towards a down payment or closing costs on the new purchase home.

“The Home Buyer credit program is ideal because the tax credit that the home buyer receives will not have to be repaid and may be used to purchase a home. Essentially, the program has stimulated the market to a point where home sales are at the highest level in over two years. It has helped many Americans reach their dream of owning a home,” explained John Karcher, president of MABA. “We are absolutely thrilled that it has been extended to the Spring.”

A business is just like nature. When something stops growing, it starts dying. We were slowing dying, and I hadn’t seen it coming.

Trust me, with the onset of the information age, a lack of ideas can COST you. The biggest cost is lost opportunity. In my business, a customer is worth an average of $20,000 a year. Most stay with us for 5 years. That means that anytime I do not get a new customer, I am losing $100,000. That is called the lifetime value of a customer. You need to run these numbers in your own business, to put perspective on what you are doing today. With no new ideas, no new reasons to buy, no new ways to bring in prospects, I am losing $100,000 over and over again.

Opportunity cost is a hard concept to grasp. It is losing what you do not have, what you cannot see, and on what you cannot borrow. Now THAT is tough to get worried about, but you need to rethink this.

Let me give you an example to make the concept clear. If I have a cow that I do not breed with a bull at the right time of the year, I cannot get her SET. (Ranch talk for "being in the motherly way.") If I do not get her SET, I am not going to have a calf next spring, a calf that I can sell or raise to breed in the future. If that cow does not calve, I do not lose anything, right? I still have the cow. What I lose is the opportunity to sell a calf.

The cost of lost opportunity is always on the minds of successful business owners. You need to consistently factor this into the equation, in order to take your business to new heights. It is a new "secret weapon" to add to your arsenal of sound business practices, as you evaluate each move you make in your company.

Fear of loss is strong. The fear of lost opportunities is a strength.

The Triple Bottom Line Explained

You may have heard representatives of companies talking about their Triple Bottom Line. You probably stayed quiet because you held to the tenant that it is far better to keep your mouth closed and be thought a fool than to open your mouth and remove all doubt. At the same time, you made a mental note to look it up on Wikipedia when you were in front of your computer. You may have forgotten to do this so we're providing you with a brief explanation here with references to some other places to learn more.

The concept of the Triple Bottom Line in its simplest terms describes expanding the traditional business reporting framework to take into account the environmental and social performance of a business in addition to their financial performance.

The concept comes from a term coined by John Elkington, founder of the think tank and consultancy SustainAbility. First adopted by the nonprofit world - and specifically those NGOs and NPOs whose missions were synergistic, it is now finding a place in the corporate world with large and small companies embracing the concept, if not the practice.

The triple bottom line is made up of three different bottom lines: separate but interrelated within the concepual framework of the Triple Bottom Line:

•social costs and benefits;
•economic costs and benefits; and,
•environmental costs and benefits.
Social Costs and Benefits: By keeping human capital in mind, from both the perspective of your workforce as well as the community, a Triple Bottom Line business integrates the well-being of the company, the employees and the community.

Environmental Costs and Benefits: A Triple Bottom Line business integrates the natural environment into its inventory of concerns at the top level. Using best practices a Triple Bottom Line business seeks to minimize its environmental impact and non renewable energy consumption.

Economic Costs and Benefits: In a Triple Bottom Line company profit takes on a broader meaning than in a company where corporate responsibility is held silent. The company is profitable in the classic sense but the profit concept is expanded to the broader community as well.

Consideration of the Triple Bottom Line can take root in a simple philosophical standard that becomes more sophisticated as the business grows or be implimented immediately as a set of standards into the accounting practices of the company. In the case of the later approach it takes on a much more complex and costly form, though - by virtue of it demonstrability - that cost may be justifiable in the market.

For this and other reasons, it is often best for companies to use consultants to develop their approach to the triple bottom line, where larger companies can afford full time employees dedicated to the process, smaller companies n a temporary basis who can bring the most current best practices to light.

Bearing in mind that Economics is not a hard science to begin with, a concept like the Triple Bottom Line is open to interpretation but, most important, by embracing a broader conceptual framework for a company's bottom line it opens up a much broader and dynamic array of best practices.

For example: the practice of recycling is in the process of evolving from a "cradle to grave" approach to a "cradle to cradle" approach. A cradle to grave approach examines the product after conception and production. In other words, a product is created and the emphasis of recycling focuses on creating the best possible way to reuse as many components as possible. In the new "cradle to cradle" approach, the corporation that produces the product considers the environmental issues initially in the conceptual stages in order to maximize the recyclability of the product and minimize the waste produced after complete recycling. Additionally the company that is employing best practices under a Triple Bottom Line imperative, gravitates to the product that has been created with a cradle to cradle approach.

An Easy Guide to do a Phoenix or Pre-Pack

Has your business got to the point that it is unable to pay its creditors? In addition company agreements such as premises leases are no longer appropriate. If this is the case, you may be considering simply cutting your losses and closing the business. There may well be business ideas and certain elements of the assets that could still be viable. However, if you simply liquidate the company, the assets could well be lost.

A pre pack liquidation (commonly known as the Phoenixing process) allows a new company to be formed which then buys the assets of the old failing business. Employees may be transferred to the new business. The old business is then closed (or liquidated) and proceeds of the sale of assets distributed to the outstanding creditors.

For this process to be successful there are a number of steps that will need to be carried out. The following steps are not necessarily sequential. The correct timing to undertake each will be advised by the insolvency professional working with the company board.

•The board members review the current business situation with a business insolvency professional and agree that a Pre Pack should be undertaken.
•A new company is formed which will buy the assets of the old business. A bank account is opened and VAT registration applied for. Generally this will be with the help of the business insolvency professional.
•An Insolvency Practitioner is introduced to the old company who will instruct a valuer to assess the value of the company's assets.
•It is often the case that the new business will want to remain in the same premises so agreement needs to be reached with the landlord to transfer the lease. As the landlord may want to renegotiate the lease in their favour it is worthwhile having an possible alternative location as a bargaining chip.
•The Insolvency Practitioner agrees to sell the assets, good will (and name if required) to the new business. There may be a deferred payment period if agreed. If finance cannot be made available through a more traditional route such as property equity release or a commercial bank loan, the area of Asset refinancing may be considered. Many asset finance companies will lend against the value of the assets such as plant and machinery to be purchased by the new company.
•Employees of the old company are transferred to the new business as required and taking into account TUPE (European law regarding the transfer of undertakings and permanent employment).
•The Insolvency Practitioner calls a creditors meeting to report on the old company's outcome to its creditors. The insolvency practitioner is appointed by creditors to liquidate the old business. The creditors will receive a share of any available proceeds from the sale of the old company's assets.
•The board of the new company get on with running the business. In order to improve cash flow, invoice factoring may be considered which may give immediate access to up to 80% of the value of all new invoices raised by the new business.
The cost of carrying out a pre pack liquidation process will normally consist of an upfront fee paid to the business insolvency specialist for the advice and assistance provided. Of course, then the funds required to buy the assets of the old business must be raised. The insolvency practitioner will take their fee for liquidating the old business from the money raised by the sale of the business assets.

The advantages of the pre pack process can be significant. The assets of the business such as important employee teams, equipment and good will are maintained whereas they may break apart if a company is simply liquidated. In addition, the liquidator will generally get a better price for the assets (especially good will) and therefore better return for creditors if they are sold as a whole to start a new business. The new company has the opportunity to operate into the future thus providing a continuing trading partner for suppliers and customers both new and old.
